Terms & Conditions for Individuals / Group booking
1. Introduction and Interpretation
1.1. This Terms and Conditions applies to all activities held by Dialogue In The Dark (HK) Foundation Limited (“Dialogue Experience”), including booking for Individual / walk-in Dark Tour participant, booking for Group Tour, Dark and Silence workshop / activities, Digital Experience, regular, irregular or other activities organised and / or held by Dialogue Experience.
1.2. Interpretation
1.2.1. “Dialogue Experience” is the tradename of Dialogue In The Dark (HK) Foundation Limited. “Dialogue Experience” shall be adopted in place of Dialogue In The Dark (HK) Foundation Limited interchangeably in the Terms and Conditions.
1.2.2. The term “Programme” refers to all activities hosted by Dialogue Experience including but not limited to Dark Tour, Dinner in the Dark, Dark and Silence workshop / activity, Digital Experience, irregular event.
1.2.3. The term “Individual Programme” refers to any service for 16 or less participants, such as dark tour consisting of 16 or less participants. Please refer to relevant part(s) of the Terms and Conditions for details.
1.2.4. The term “Group Programme” refers to any service for a group of 17 or more participants, such as dark tour for 17 or more participants, Dark and Silence Workshop, Silence workshop, Digital Experience, irregular activities or events. Please refer to relevant part(s) of the Terms and Conditions for details.
1.3. For booking of service of Digital Experience, please refer to relevant parts of the Terms and Conditions and other supplementary terms and conditions, requirement, rules etc. issued by Dialogue Experience from time to time on our website.
1.4. For booking of regular and / or any other activities, please refer to relevant parts of the Terms and Conditions and other supplementary terms and conditions, requirement, rules etc. issued by Dialogue Experience from time to time on our website for details.
1.5. The term “ Organisation(s)” refers to anybody other than a natural person, such as school, company (whether incorporated or unincorporated), association, a partnership, a sole proprietor acting under a tradename or any other form of organisation other than the aforesaid etc.
2. Booking Procedure
2.1. Please go through all terms and conditions before submitting the booking form via our online ticketing system. All bookings will be booked through our online ticketing system.
2.2. Individual Programme
2.2.1. Individual participants of Dark Tour or Dinner in the Dark may book and reserve the said programme via our online ticketing system. You are advised to settle the payment through our online ticketing system. The process of transfer of payment from you to Dialogue Experience is handled by a third-party payment system.
2.2.2. Dialogue Experience shall not keep, collect or retain your personal data as to your payment particulars, including but not limited to your credit card number, name of account holder, account name and number, expiry date of credit, payment code etc.
2.2.3. If individual participants are unable to settle the payment via our online ticketing system, they may choose to settle the same by bank transfer, cash or cheque.
2.2.4. In the event that the booked programme is not available on the reserved date and time by whatever reason, we shall then inform you via email or other means for re-scheduling. Upon reaching a mutual agreement for the date, time, mode and all other details of the programme, we shall then send you a confirmation letter via email or other means. The confirmation letter shall be deemed to be a conclusive evidence indicating your acceptance to the agreement.
2.2.5. It is assumed that you understand and agree with all terms and conditions listed herein. The contract between Dialogue In The Dark (HK) Foundation Limited and you take immediate effect and no cancellation or change in any booking details is accepted, including but not limited to visit date and time, selection of programme, arrangement of programme, number of participants, language, etc.
2.2.6. Within 3 days of the booking or the day before programme date, whichever is the earlier, you are bound to settle the outstanding amount.
2.3. Booking of Group Programme
2.3.1. Within 5 working days upon receipt of your booking form, we will reserve the programme and send you a confirmation letter together with an invoice. If your preferred date or timeslots are not available, we will contact you and notify the booking result or alternative arrangement via email within 5 working days from the date of application for an acceptable date to both the application party and Dialogue Experience. Upon reaching a mutual agreement for the date, time, mode and all other details of the programme, we shall then send you a confirmation letter via email. The confirmation letter shall be deemed to be a conclusive evidence indicating your acceptance to the agreement.
2.3.2. Upon confirmation of arrangement, it is assumed that you understand and agree with all terms and conditions listed herein. The contract between Dialogue In The Dark (HK) Foundation Limited and your organisation takes immediate effect and no cancellation or change in any booking details is accepted, including but not limited to visit date and time, selection of programme, arrangement of programme, number of participants, language, etc.
2.3.3. The Person-in-Charge acting on behalf of the organization(s) has to settle the full cost of the programme either 1 month after invoice date or 14 working days prior to the programme date, whichever is the earlier (as the case maybe).
2.3.4. If Dialogue Experience does not receive the payment from the Person-in-Charge 14 working days before the programme date, Dialogue Experience reserves the right to cancel the reservation without further notice.
3. General Entry Rules for All Participants 3.1. Requirements on age
Participants should be at least 9 years old to join the programme by oneself without accompanied by adult caretaker. For children between 5 to 8 years old, he / she should be accompanied by one adult or guardian to join the dark tour.
3.2. Student discount
Student discount may apply to all local and overseas full-time students. Person-in-Charge of organisation or individual participant shall check with our staff the details of discount / promotion package prior to purchasing our tickets because these discount / promotion package may be reviewed by Dialogue Experience from time to time. Dialogue Experience reserves the right to review, cancel, suspend, alter the any discount / promotion plan without further notice and in the event of any dispute as to the discount / promotion plan, the decision of Dialogue Experience shall be final.
3.3. Elderly discount
Elderly discount may apply to all persons over 65 years old. Person-in-charge of organisations or individual participant shall check with our staff the details of discount / promotion package prior to purchasing our tickets because these discount / promotion package may be reviewed by Dialogue Experience from time to time. Dialogue Experience reserves the right to review, cancel, suspend, alter the any discount / promotion plan without further notice and in the event of any dispute as to the discount / promotion plan, the decision of Dialogue Experience shall be final.
3.4. Birthday discount
Birthday Discount may apply only to individual programme booked by group consisting less than 17 participants. There shall be no birthday discount for participants under booking for programme by group consisting of 17 or more participants. Person-in-charge of organisations or individual participant shall check with our staff the details of discount / promotion package prior to purchasing our tickets because these discount / promotion package may be reviewed by Dialogue Experience from time to time. Dialogue Experience reserves the right to review, cancel, suspend, alter the any discount / promotion plan without further notice and in the event of any dispute as to the discount / promotion plan, the decision of Dialogue Experience shall be final.
3.5. Discount for People with disabilities
The discount may apply to all persons with “Registration Card for People with Disabilities”. Person-in-Charge of organisations or individual participant shall check with our staff the details of discount / promotion package prior to purchasing our tickets because these discount / promotion package may be reviewed by Dialogue Experience from time to time. Dialogue Experience reserves the right to review, cancel, suspend, alter the any discount / promotion plan without further notice and in the event of any dispute as to the discount / promotion plan, the decision of Dialogue Experience shall be final.
3.6. Discount for Caretaker of Participants with Special Needs
The discount may apply to all persons who accompany and take care of participants with special needs. Please refer to the Special Arrangements for Dark Tour Participants with Special Needs”) for details. Person-in-charge of organisation or individual participant shall check with our staff the details of discount / promotion package prior to purchasing our tickets because these discount / promotion package may be reviewed by Dialogue Experience from time to time. Dialogue Experience reserves the right to review, cancel, suspend, alter the any discount / promotion plan without further notice and in the event of any dispute as to the discount / promotion plan, the decision of Dialogue Experience shall be final.
3.7. Identity proof
All participants may be requested to present their valid identity cards for verification purpose only, e.g. student cards, registration card for people with disability, identity cards or passports. We shall not retain or record the personal data shown on these documents. If it is deemed necessary, upon checking such information by our staff, we shall return the said documents to the holders or the Person-in-Charge. Please also refer to our Privacy Policy (or called “Collection of Personal Data Policy”) for more information.
3.8. Assessment of participant’s personal physical and psychological suitability Participants have to consider their physical and psychological suitability in participating the experiential programme(s) held by Dialogue Experience / Dialogue In The Dark (HK) Foundation Limited or its affiliated companies / organisations / persons agents, principals, staff, employees, whatsoever are not to be held responsible for any injuries or accidents that happen when participants fail to communicate the needs to our staff before the experiential programme(s) and/or dark tour(s).
3.8.1. In normal circumstances, we welcome participants be mobile with wheelchairs or any mobility aids (e.g. canes, crutches, walkers, mobility scooters etc.) to join our programme on the condition that they are required to notify us their special needs prior to booking and are requested to take wheelchairs provided by Dialogue Experience. We will not admit any liability in the event of wheel transfer. Each participant with special needs has to be accompanied by one caretaker to join the tour. Dialogue Experience / Dialogue In The Dark (HK) Foundation Limited or its affiliated companies / organisation / persons agents, principals, staff, employees, whatsoever shall not be held responsible for any injuries or accidents that happen when participants fail to communicate the special needs to our staff before the experiential programme dark tour(s).
3.8.2. By reason that There are certain risks in the dark zone at the Dialogue Experience Place (DEP), and merely for the purposes of protecting the physical health and safeguarding pregnant women, they are not allowed to participate our dark tours. Dialogue Experience / Dialogue In The Dark (HK) Foundation Limited or its affiliated companies / organisation / persons agents, principals, staff, employees, whatsoever shall not be held responsible for any injuries or accidents that happen when the pregnant participants fail to notify our staff her pregnancy before the dark tour(s).
3.8.3. Persons with heart problems, panic disorders, severe chronic diseases or any other diseases or illness that may be harmful to the participant during the experiential programme(s) or dark tour(s)are not recommended to join the experiential programme(s) or dark tours. People with these illness or diseases shall consult the medical specialists before purchasing tickets. Dialogue Experience reserves the right not to allow participants with health problem(s) to enter the DEP for safety reasons and the payments received by Dialogue Experience are not refundable.
3.9. Organisation’s self-assessment towards participants with special needs Schools and Organisations have the responsibility to assess participants with special physical or psychological needs, including physical handicap, hearing impairment, phobia, claustrophobia, Autism, ADHD, mental retardation, dementia etc. Organisations must notify staff of Dialogue Experience during booking process or remarked the details of the special needs on the booking form in order to let Dialogue Experience make appropriate arrangement. If organisations fail to notify staff of Dialogue Experience the special needs of participants, Dialogue Experience reserves the right to cancel the experiential programme(s) or dark tour(s)and the payment received shall not be refundable in any event. For details, please refer to “Special Arrangements for Dark Tour Participants with Special Needs”.
3.10. This Terms and Conditions is a general guideline for all participants. In the event of special situation, Dialogue Experience reserves the right to alter any term of this Terms and Conditions by way of prior communication, verbal consensus between Dialogue Experience and the party, execution of written agreement, etc. If there is discrepancy between this Terms and Conditions and the tailor-made arrangement as mentioned here, the later shall prevail. Dialogue Experience further reserve the rights to modify any requirement as listed and such decision is final.
4. Language of Experiential Programme(s) / Dark Tour(s)
Unless specified otherwise, all programmes shall be conducted in Cantonese. English and Putonghua tours may only be arranged when requested on the booking form or specified before the confirmation letter is issued depending on the availability of English and Putonghua tour guides, coaches, facilitators etc.
5. Arrangement / Grouping for Dark Tour Participants
5.1. Arrival: All participants must arrive the DEP on time as the introduction will only be conducted once. Late-comers are not allowed to enter into the DEP on account that the unique settings of the DEP may put the participants in danger in the circumstances of having not attending the introductory session prior to the programme. Dialogue Experience reserves the rights to alter the tour timing or pre-and post-tour activities for operational reasons without prior notification.
5.2. Grouping of Participants:
5.2.1. All individual participants notwithstanding the same group / organisation maybe grouped with other walk-in participants.
5.2.2. Organisations may divide the participants into groups in advance. Participants should be divided into groups of 8 to join the dark tours. If the total number of participants is not a multiple of 8, the organisations still have to make such arrangement. When the last group of participants doing the dark tours consists of less than 8 participants, other walk-in participants may be joining the group.
5.2.3. For operational reasons, Dialogue Experience reserves the right of final decision on grouping of all participants notwithstanding the same group / organisation may be grouped with other participants or participants of other group / organisation.
5.3. Sharing session: Sharing session shall be offered only if the group has made reservation during booking. Due to the limited manpower, space and capacity of Dialogue Experience, we shall not cater group request to carry out their own sharing session at our venue.
6. Activity Rules for All Participants
6.1. Participants must only enter the DEP under the guidance of our tour guides or staff to ensure safety, participants must abide by all rules given by Dialogue Experience in advance to the programme and instruction given by our staff during and before the programme.
6.2. If participants feel unwell during the programme, Dialogue Experience, depending on the actual circumstances of the health condition of such particular participants, will guide them to the rest area. Participants cannot rejoin the experiential programme(s) once quitted.
6.3. Smoking or lighting a fire is strictly prohibited in the DEP.
6.4. Personal belongings
6.4.1. Dialogue Experience prohibits all light-emitting devices in the DEP to ensure all participants have a pitch-black journey (e.g. watches, mobile phones, camera etc.). Personal belongings must be stored in the lockers provided by Dialogue Experience located in the vicinity outside the dark zone or at any specified location designated by our staff. Participants shall be given the keys for your custody during the programme.
6.4.2. Valuable items are not recommended. You are not recommended to bring along any valuable items to DEP. We shall not admit responsibility for any damage / loss of items locked in the lockers or damage / loss of your personal belongings being taken by participant to the venue of programme.
6.5. Food or drinks: Food and drinks are not allowed in the DEP. Participants should finish consumption before entering the programme zone of DEP save and except the food and drinks are provided sold from Dialogue Experience as part of the arrangement of the dark Experience programme during the programme inside the DEP.
6.6. Small Change of Money: Depending on the arrangement of the programme in the DEP, participants may be required to prepare a small amount of money for consumption of food and drinks in the dark zone during the programme. In such a case, participants are advised to prepare small change of money for use in the programme as large bank notes are not accepted during the programme.
6.7. Clothing: Participants are advised to put on casual wear. High heels and slippers are not allowed in avoidance of any risk or potential risky situation arising from the uneven surface of the ground or any other unexpected environment. Dialogue Experience reserves the right not to allow participants who are wearing unsuitable clothes or shoes in participating the programme andour decision is final. All fees being paid are not refundable.
6.8. Walking aid: Participants shall be provided with a walking cane and be briefed the skills and tactics in using the said canes before entering the dark zone of the DEP in the case of participating in our darkness related programme.
6.9. In the event of emergency or occurrence of unexpected situation which may jeopardize the safety of participants and / or our staff our cause unreasonable or unmanageable operation of the programme by whatever reasons, participants shall be abided by all instructions, rules and regulations given by our staff for the mere purpose of protecting their interest in broad sense.
6.10. Audio Recording, videotaping, photo taking, live broadcasting through digital device or marking, notetaking or recording the scene, details of activities, the settings of the programme venue or the DEP in any means and forms are strictly prohibited save and except the said acts have been duly approved by Dialogue Experience in writing upon receipt of the application sent by the participants or relevant parties.
7. Liability
7.1. Participants are not recommended to bring along valuable personal belongings to DEP . We will not accept responsibility for any damage / loss of items locked in the lockers or damage / loss of your personal belongings being taken by participant to the venue of programme. Dialogue Experience / Dialogue In The Dark (HK) Foundation Limited or its affiliated companies / organisations / persons agents, principals, staff, employees, whatsoever shall not be responsible for any damage/loss of property locked in the locker or damage / loss of personal belonging being bought along with the participants during the programme.
7.2. Touching and exploration in the experiential tour or programme are encouraged. However, participants shall repay Dialogue Experience the original costs of our properties damaged caused by the willful act or negligence of the participants in the event of the participants concerned do not follow the instructions and rules given by Dialogue Experience. Unlawful removal and appropriation of any property of the DEP without the consent or approval from Dialogue Experience is not allowed. Dialogue Experience reserves the rights of reporting the case to relevant law enforcement Authorities and the participants shall be liable for such criminal and civil wrongdoing act(s) done by the participants.
7.3. Due to the unique settings of the DEP, late-comers shall not be allowed to rejoin the activity. The tickets purchased and the tour reserved are non-refundable and non-exchangeable.
7.4. For dark tour, participants having left the tour for whatever reasons are not allowed to join the dark tour(s) again, unless participants reserve other tour at the available time-slot or day by purchasing new tickets through our official or approved ticketing system and / or at our counter directly.
7.5. Dialogue Experience reserves the right to deny admission, or to require visitors / participants already entered into the tour to leave the DEP without refunding or compensation by reason of their failure to comply with any of the DEP rules, for unsafe, illegal or offensive behavior, to ensure safety, security and order, or if Dialogue Experience considers that the circumstances so require.
7.6. For safety or unexpected circumstances, Dialogue Experience reserves the right to cance l or alter the touring time of participants without prior notice, refunding or compensation.
7.7. Participants shall consider their own physical and psychological suitability to enter a complete dark or silence environment. Participants shall bear their own responsibilities of entering into a complete zone of darkness or silence and shall also be bound to take the duty envisaging any possible danger insider Dialogue Experience prior to submitting the booking Form and / or entering into the Dar / Silent Zone. Dialogue Experience / Dialogue In The Dark (HK) Foundation Limited or its affiliated companies / organisations / persons agents, principals, staff, employees, whatsoever shall not be responsible and shall not assume liability for any damages, injury, losses or otherwise that occur in the dark, whether or not the damage is caused by Dialogue Experience’s negligence or otherwise.
8. Copyrights & Confidentiality
Participants agree that all intellectual property rights and all copyrights in relation to the DEP materials produced by Dialogue Experience remains with our companies. Participants shall take all practicable steps to ensure the confidential information is protected with reasonable care. No photo, audio or video recording is allowed during the entire tour. Dialogue Experience reserves the right to initiate legal actions or other lawful procedures for damages or compensations arising from and/or resulting from the infringement of the intellectual rights of Dialogue Experience by the participants or visitors, or otherwise of our website or any other materials of Dialogue Experience.
9. Issue of Invoice
9.1. In General, Dialogue Experience will email an electronic invoice upon confirmation. Hard copy of invoice will only be issued upon request. Dialogue Experience reserves the rights to recover the costs by all means under the laws of Hong Kong in the event that the outstanding sum of costs is not settled in full or in part by the individual participants.
9.2. Invoice title: The invoice will be attended to the participant / organisation and name of the person-in-charge as provided in the booking form.
9.3. Issue of more than 1 invoice: Dialogue Experience shall issue invoice according to the name of the organisation and the person-in-charge as marked on the booking form. Please note that only one invoice will be issued for each booking order and we shall not separate the programme booked items into 2 or more invoices for any organisation.
10. Payment Terms
10.1. Payment deadline: Upon the issue of invoice, the person-in-charge or participants for individual programme (if his / her application for invoice and receipt is granted) has to settle the full payment stated on the invoice within one month after invoice date or 14 working days before the programme date whichever is the earlier. If the organisation fails to settle the payment before the deadline, Dialogue Experience reserves the right to cancel or re-arrange the booking, while the invoice remains valid and the organisation is still obliged to settle the full payment. Dialogue Experience reserves the right for making the final decision.
10.2. Payment method
10.2.1. For both payments by cheque or bank transfer or electronic payment, please provide the invoice / order number, organisation name, programme date and tour or programme timeslots for our reference and verification.
10.2.2. By Cheque: The cheque should be made payable to Dialogue In The Dark (HK) Foundation Limited depending on the mode, nature and the relevant entity of Dialogue Experience having communicated with your or the organisation concerned, the individual or organisation shall sent the cheque to the “Unit B, 7/F., D2 Place ONE, 9 Cheung Yee Street, Cheung Sha Wan, Kowloon, Hong Kong”.
10.2.3. By bank transfer or electronic payment: Please transfer the amount of fees quoted to the designated bank account number as shown on the confirmation letter / invoice. Payment slip or customer advice should be sent to relevant departments as shown on the confirmation letter / invoice.
11. Receipt
11.1. Dialogue Experience shall send the receipt via email and we shall not send the receipt by post unless prior application is granted allowing the individual participants or Person-in-Charge to pick up the receipt on site instead on the programme date.
11.2. Issue of more than 1 receipt: Dialogue Experience shall issue receipt according to the name of the individual participants / organisation and the person-in-charge on the booking form. It is noted that only one invoice shall be issued for a booking order Dialogue Experience shall not separate 2 or more items or receipts for one programme to the same organisation or group of individual participants in relation to the afar said programme.
12. Postponement or Amendment of Programme Arrangement
12.1. Special Severe Weather Conditions: For severe weather arrangements, please kindly refer to the “Severe Weather Arrangement Guideline” sent along with confirmation letter or website for details.
12.2. Dialogue Experience shall accept re-scheduling after the booking is confirmed, only under the following bad weather conditions issued by the Hong Kong observatory, i.e. Black Rainstorm Signal and Typhoon Signal no. 8 or higher: All the re-scheduling dates shall be within 2 weeks (individual) or 3 months (group) of the original visit date if practicable. However, in the event that Dialogue Experience is not able to re-schedule the experiential programme(s) or dark tour(s) within 2 weeks or 3 months from the original date as scheduled by whatever reason, we shall notify the individual participants or relevant person-in-charge or the organisation directly so as to fix a new date with the mutual agreement between Dialogue Experience and the organisation as soon as practicable after further discussion.
12.3. For unpaid customers, customers are advised to make a new booking by themselves after the removal of the Black Rainstorm warning and / or Typhoon Signal No.8.
12.4. Due to unforeseen, unexpected, uncontrollable and unmanageable situation, Dialogue Experience reserves the right to adjust the opening hours without prior notice.
12.5. In the event the individual participants of individual programme or the organisations or groups are unable to participate the programme, the individual participants or the person-in-charge of the organisation shall give Dialogue Experience written application supporting by reasonable grounds for re-scheduling the programme date and time. Given the limited resources, manpower and space of Dialogue Experience, such application may be approved only basing on our absolute discretion as well as our resources available. Dialogue Experience reserves the right for making the final decision. If the application for re-scheduling is approved, the individual participants or the organisations shall participate or start rescheduling the programme(s) by communicating with Dialogue-Experience within 3 months, otherwise, Dialogue Experience shall not re-schedule the programme again upon expiration of 3 months from the date of the original date of programme and the paid fees for the programme are non-refundable.
13. Other Conditions of Use
13.1. In case of any dispute, Dialogue Experience reserves the right to interpret this Terms and Conditions and make the final decision as to any matters arising from the same.
13.2. It is assumed that you understand and agree with all terms and conditions listed hereinabove. The contract between Dialogue Experience and your organisation / individual participants takes immediate effect and no cancellation or change in any booking details is accepted, including but not limited to visit date and time, selection of programme, arrangement of tour, number of participants, language, etc.
13.3. It is further provided that Dialogue Experience has the rights to amend, alter, cancel or terminate any terms of this Terms and Conditions without prior notice and we may also amend, alter or cancel any terms under this Terms and Conditions from time to time. Dialogue Experience may also withdraw or terminate the Terms and Conditions if it is deemed necessary and think fit to do so without any prior notice. Individual participants or the organisation concerned shall be bound by our amended or updated Terms and Conditions and for the sake of understanding the rights and obligations under the current effective Terms and Conditions of Dialogue Experience, you are reminded to visit our website regularly for the most updated information and our up-to-date details of Terms and Conditions for reference.
In the event there is any discrepancy between the Chinese version and English version of this document, the English one prevails.
